Cal/OSHA Issues Notice, Schedules Public Hearing on Process Safety Management (PSM) Program Assessment

CAL-OSHA has issued a Notice of Rulemaking (pdf) after Emergency Adoption to make permanent the recently adopted Process Safety Management Program Assessment regulations.  A public hearing has been scheduled for 10 a.m., February 3, 2014 in the auditorium of the Elihu Harris Building, 1515 Clay Street, Oakland, CA 94612. Members of the public may also submit written comment on the regulations until 5 p.m. that day.  The emergency regulations adopted sections 344.76 and 344.77 in Article 12.5 of Subchapter 2, of Title 8, California Code of Regulations. The regulations implement a methodology for determining and collecting an annual assessment to fund the DOSH Process Safety Management Program (Labor Code sections 7855 – 7870). The emergency regulations became effective on October 29, 2013, and will remain in effect for a period of 180 days (until April 29, 2014). The purpose of this rulemaking is to formally adopt the emergency regulations on a permanent basis.  The Notice, Initial Statement of Reasons, and proposed text of the regulations may be accessed and downloaded from the Division’s website.
