CSB’s proposed chemical accident reporting rule (CFR 1604)

The CSB proposes to add a new part to title 40 of the Code of Federal Regulations, which will appear as a new part 1604. The proposed part will consist of six (6) sections.

  1. Proposed § 1604.1 states the purpose of the rule.
  2. Proposed § 1604.2 sets forth key definitions.
  3. Section 1604.3 sets forth who must file a report and when.
  4. Section 1604.4 describes the information required in each report.
  5. Section 1604.5 implements the enforcement provisions authorized by 42 U.S.C. 7412(r)(6)(O).
  6. Section 1604.6 confirms that the procedure for seeking records obtained pursuant to the rule is governed by the Freedom of Information Act (FOIA), 5 U.S.C. 552, the CSB’s procedural regulations for disclosure of records under the FOIA, 40 CFR part 1601, and other pertinent Federal disclosure laws.
