This case is going before the full review commission, but below are the ALJ’s view on the citations. This case is what we (the safety profession) warn employers what can happen with a lack of proper oversight. The citations are about as basic as they come and the CSHO nailed the inspection with great documentation and rationale. She found issues with the following and ALL citations were upheld:
- Noise exposure
- Combustible dust housekeeping
- FLammable Liquids transfers
- Fire extinguisher,
- Lockout-tagout,
- Machine guarding,
- Powered industrial truck,
- Electrical,
- Bloodborne pathogen,
- Accident reporting,
- Training,
- Recordkeeping and
- Hazard communications
OSHA opened an investigation at Respondent’s facility in response to a May 6, 2016 accident that seriously injured an employee. As a result, OSHA cited Respondent for thirty violations with a total proposed penalty of $180,592. Of the cited violations, two were classified as willful, twenty-three as serious, and five as other-than-serious.
