On March 19, 2012 EPA conducted a compliance inspection of food facility to determine its compliance with the Risk Management Plan (“RMP”) regulations. EPA has determined that Respondent violated the following regulations:
- 40 C.F.R. § 68.65(d)(2)Respondent failed to document that equipment complies with recognized and generally accepted good engineering practices; and
- 40 C.F.R. § 68.79(d) Respondent failed to promptly determine and document an appropriate response to each of the findings of the compliance audit and document that deficiencies had been corrected.
In consideration of Respondent’s full compliance history, its good faith efforts to comply, other factors as justice may require, and upon consideration of the entire record, the parties enter into this ESA in order to resolve any civil penalties for these alleged violations for the total penalty amount of $1,800.00.
