Yesterday, OSHA announced its plans to promulgate a revised Process Safety Management (PSM) standard and a NEW Emergency Response Standard in 2023. Executive Order 12866 requires the semiannual publication of an agenda of regulations listing all the regulations the Department of Labor expects to have under active consideration for promulgation, proposal, or review during the coming one-year period. It will be interesting to see how the new ER standard will be covered in the revised PSM standard and whether the revised PSM standard will have two (2) types of CAT 1 flammable gases (i.e., 1A and 1B), based on OSHA’s desired to adopt Revision 7 of the GHS for its HAZCOM standard (also due to happen this year, but NOT listed in its CFR posting.
