PSM and RMP Citations/Analysis

NOTICE:  The OSHA cases found in these posts may be taken from OSHA citations BEFORE the “informal conference” takes places.  These cases are posted for AWARENESS and EDUCATIONAL purposes only.  I have scrubbed company names and locations from my postings, but not from the OSHA and EPA documents.  These posts are in NO WAY meant to shame any company, just providing information showing the things OSHA/EPA are finding in their PSM/RMP inspections.

Company to pay over $1M to OSHA and EPA for fatal NH3 release during pump down (NH3 Refrigeration)

EPA RMP citations @ Ethanol Plant ($7,500)

On September 14, 2011 EPA conducted a compliance inspection to determine its compliance with the Risk Management Plan (“RMP”) regulations promulgated pursuant to Section 112(r) of the Act,. and set forth at 40 C.F.R. Part 68. Based on the Inspection and documents submitted by Respondent, EPA has determined that Respondent violated the following regulations:

OSHA issues PSM citations to propane facility after fire ($105,000)

OSHA has cited the propane facility with 21 serious violations following a November 2012 fire that required three workers to be hospitalized and four workers to be treated and released. The plant inspection was expanded to include the national emphasis program on Process Safety Management Covered Chemical Facilities. Proposed penalties total $105,000.  The serious violations

OSHA cites Dairy facility for 14 violations of workplace standards ($74,610)

OSHA has cited dairy food company with 10 serious, two repeat and two other-than-serious violations. OSHA began an inspection in November 2012 under its Site Specific Targeting Program that directs enforcement resources to high-hazard workplaces, where high injury and illness rates occur, and the National Emphasis Program on facilities, covered under the Process Safety Management

EPA cites Ammonia Distributor $5,000

On August 16, 2012, EPA conducted a compliance inspection of the Respondent’s facility to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the CAA. The EPA found that the Respondent had violated regulations implementing Section 112(r) of the CAA by failing to comply with

On January 24, 2012, EPA conducted a compliance inspection to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the CAA. The EPA found that the Respondent had violated regulations implementing Section 112(r) of the CAA by failing to comply with the regulations as noted
